General Terms and Conditions for using the e-service environment of the Estonian Transport Administration
General provisions
1. In conformity with Estonian regulations, Estonian Transport Administration offers to take advantages of using e-services for everyday public operations.
2. An individual (hereinafter the user of services), using the e-service environment of the Estonian Transport Administration, agrees to abide by these general terms and conditions.
3. Identity of the user will be identified by means of ID card, Mobile ID, X-road or some other identification service, acceptable for the Estonian Transport Administration.
4. If not provided otherwise by the State Fees Act, state fee will be due on any transaction.
5. Opening hours of the Estonian Transport Administration: Monday-Thursday 8 am - 4.45 pm and Friday 8 am - 3.30 pm.
Rights, duties and confirmations of the user of the services
6. The user of the services will have the right to use the e-service of the Estonian Transport Administration only in compliance with the current terms and conditions and the valid law of the Republic of Estonia.
7. The user of the services will undertake to use the e-service of the Estonian Transport Administration for purposes laid down by law and good practice.
8. The user of the services will have the right to file proposals and pretensions, concerning the e-service of the Estonian Transport Administration, to the Estonian Transport Administration in writing (Valge 4, 11413 Tallinn) or by e-mail ([email protected]).
9. The user of the services is aware and confirms that the documents, submitted via the e-service environment of the Estonian Transport Administration by the user of services or his/her representative have the effect and force equivalent to documents signed by their own hand.
10. The user of the services confirms of being aware of the requirement to submit only true information, in due time and upon the terms and conditions, laid down by law.
11. The user of the services confirms of being aware of the fact that submission of falsified information shall result in criminal liability.
12. The service user agrees that the Estonian Transport Administration shall make an inquiry about the service user for the performance of statutory tasks to obtain his or her photo and specimen of signature to be entered into the database of personal identification documents and to receive the motor vehicle driver’s medical certificate data of the Health Information System. The Estonian Transport Administration shall also make an inquiry from the Health Information System if the service user has made an inquiry to obtain his or her medical certificate data. The service user is aware that the Estonian Transport Administration shall have the right to make inquiries about him or her and obtain data from the Criminal Records Database, the Population Register, and other national or local government databases for the performance of statutory tasks.
13. Е-service user agrees to provide his/hers telephone number and email addsress to the e-service environment of the Transport Administration.
Rights and duties of the Estonian Transport Administration
14. Estonian Transport Administration has right to be used his/her contact information for sending notifications, resulting from the activities of the Estonian Transport Administration (e.g. Expiry of a driving license, arrival of a due date for technical inspection) and to conduct surveys, related to the provision of public services (Traffic Act § 173 (4)).
15. The Estonian Transport Administration shall undertake to process the personal information of users of services in accordance to the provisions of the Personal Data Protection Act and not to forward such information to any third parties if not provided otherwise by law.
16. The Estonian Transport Administration will not take any liability to third parties for the accuracy of the information, entered by users of services via the e-service environment of the Estonian Transport Administration.
17. Should the Estonian Transport Administration have any suspicions regarding the accuracy of the documents or data, submitted by users of services, the Estonian Transport Administration shall have the right to forward such documents to a competent government authority for inspection and require submission of correct and accurate documents and data of the user of services concerned.
18. The Estonian Transport Administration shall have the right to check the accuracy of the submitted information before any register entries are made, making, where appropriate, inquiries or using any other methods, and require submission of correct and accurate documents and data of the user of services concerned.
19. The Estonian Transport Administration shall have the right to suspend the proceedings for reviewing the application and refuse from making the requested entry to the register until proper documents or data are submitted.
20. The Estonian Transport Administration shall have the right to restrict the access of the user of services, on temporary or permanent bases, to the e-service environment of the Estonian Transport Administration if the Estonian Transport Administration has found that the user has submitted falsified information, breached these general terms and conditions or violated the procedure, governing the use of the e-service environment of the Estonian Transport Administration in a way that conflicts with the law of the Republic of Estonia.
21. The Estonian Transport Administration shall have the right to require digital signing of the documents, submitted via e-service environment of the Estonian Transport Administration, if provided by law.
22. The Estonian Transport Administration has the right to modify these general terms and conditions unilaterally, publishing the modification or amendment, before entering into force, either in the e-service environment or on the website of the Estonian Transport Administration (www.transpordiamet.ee).
23. The Estonian Transport Administration has the right to modify the e-service environment of the Estonian Transport Administration without giving an advance notice to users.
24. The Estonian Transport Administration shall be required to ensure the security of the data and information, acquired by means of the e-service environment of the Estonian Transport Administration.
25. The Estonian Transport Administration is required to safekeep the documents and data, submitted by users of services by means of the e-service environment, as provided by law.
Copyrights
26. The Estonian Transport Administration or the entity who created the materials is the sole owner of the copyrights of the contents (including graphics, logos, texts, icons, images) and software of the e-service environment of the Estonian Transport Administration. Contents and software of the e-service environment of the Estonian Transport Administration is protected by law.
27. The aforementioned information, available from the e-service environment of the Estonian Transport Administration, must not be copied, multiplied, transferred or distributed or used by any means without a prior written consent of the Estonian Transport Administration. The breach of this requirement shall result in liability.
28. The e-service environment of the Estonian Transport Administration is the property of the Estonian Transport Administration and protected by law. Breach of law shall result in liability.
Final provisions
29. These terms and conditions will remain in force for an unspecified period.
30. Any disputes, arising from these general terms and conditions, will be settled by the user of services and the Estonian Transport Administration by means of negotiations. Should the parties fail to come to an understanding, the dispute will be settled as specified in the law of the Republic of Estonia.
31. Both the user of the services and the Estonian Transport Administration will be held liable for unsuitable performance or non-performance of the duties, arising from these general terms and conditions, as provided by the general terms and conditions or the law of the Republic of Estonia.
